Terms of Use

These terms are an agreement between you and Oleh Rybakov, Estoril, Portugal ("we", "us") about your use of the TypeInstead app for macOS ("the app"). By installing or using the app you accept them. If you do not accept them, do not use the app.

1. Your licence

While your purchase or subscription is valid, we grant you a personal, non-exclusive, non-transferable licence to install and use the app on Macs that you own or control, for your own purposes, including your own commercial work. We license the app to you; we do not sell it to you. Everything not expressly granted here stays with us.

2. Buying it, and refunds

The app is distributed and sold through Setapp, a service operated by MacPaw. Setapp is the merchant of record: it takes your payment, issues your invoice, handles cancellations and refunds, and delivers updates. Prices, billing periods, any free trial and the refund policy are therefore governed by Setapp's own terms, and your account relationship is with Setapp. We have no access to your payment details.

If your subscription ends or is refunded, your licence to use the app ends with it. Your snippets remain your own files on your Mac, and you can back them up from inside the app at any time.

3. What you may not do

• Copy, redistribute, sell, rent, sublicense or lend the app, or make it available to anyone else.
• Modify the app, or reverse engineer, decompile or disassemble it, except to the extent that law expressly permits despite this restriction.
• Remove or alter any notice of ownership, or circumvent the licence check.
• Use the app to break the law, to infringe anyone's rights, or to capture another person's keystrokes or data without their knowledge and consent.

4. The Accessibility permission

The app needs macOS's Accessibility permission to notice your triggers and to insert content into other apps. You grant that permission yourself in System Settings and can withdraw it at any time, which stops the app expanding snippets. What the app does with keystrokes is described in the Privacy Policy. You are responsible for installing the app only on Macs you are entitled to configure this way, and for not using it to monitor anyone else.

5. Your content

Your snippets, and the files they point to, are yours. We claim no rights over them and we never receive them. You are responsible for what you insert into messages and documents, for keeping your own backups, and for not saving anything into the app that you are not permitted to hold.

6. Updates

We may release updates that fix, change or remove features. Updates are delivered through Setapp and are covered by these terms. We may stop supporting older versions of macOS in a future release; the system requirements stated for the version you have will not change.

7. No warranty

The app is provided "as is". To the fullest extent the law allows, we make no warranties of any kind, express or implied, including fitness for a particular purpose, and we do not warrant that the app will be uninterrupted, error-free, or that it will insert content correctly in every app you use. Text expansion acts inside other people's software, and the result depends on what each app accepts.

Nothing in these terms limits any rights you have as a consumer that cannot be limited by law, including statutory rights about goods and digital content that are not of satisfactory quality or as described.

8. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, for lost profits, data or business, or for anything you send or publish with the app's help. Where we are liable, our total liability is limited to the amount you paid for the app in the twelve months before the claim. We do not exclude liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

9. Ending the agreement

You may stop using the app and delete it at any time. We may end your licence if you materially breach these terms and do not put it right within 14 days of us asking. On termination you must stop using the app and remove it; sections 5, 7, 8 and 10 survive.

10. Governing law

These terms are governed by the law of Portugal, and the courts of Portugal have jurisdiction. If you are a consumer resident elsewhere, this does not deprive you of the protection of your local law.

11. Everything else

If any part of these terms is unenforceable, the rest stays in force. Our not enforcing a term is not a waiver of it. You may not transfer these terms; we may transfer them if our business is sold, on notice to you. These terms, with the Privacy Policy, are the whole agreement between us about the app. We may update these terms, and will publish the new version here with a new effective date; if a change materially affects your rights, we will say so in the app or by email before it applies to you.
